Senate Dems' bill light on deficit cuts in 2013

(AP) ? White House-backed legislation in the Senate to replace $85 billion in across-the-board spending cuts would raise the deficit through the end of the budget year by tens of billions of dollars, officials said late Wednesday as the two parties maneuvered for public support on economic issues.

The nonpartisan Congressional Budget Office said that under the Democratic measure, deficits also would rise in each of the next two years before turning downward.

Democratic officials had said earlier in the day their bill would spread one year's worth of anticipated savings ? $85 billion ? over a decade in an attempt to avoid damaging the shaky economic recovery.

The legislation would cancel across-the-board cuts due to begin on Friday. Instead, it would eliminate payments to some farmers, enact defense reductions beginning in two years and impose tax increases, mostly on millionaires.

White House spokesman Jay Carney recently told reporters at the White House the administration supports the measure.

The Senate is expected to vote on Thursday on rival Democratic and Republican plans to replace the spending cuts, known in Washington-speak as a "sequester." Both bills are expected to fail.

In an indication that across-the-board cuts are inevitable, President Barack Obama has set a meeting with congressional leaders for the day they take effect. While the administration has warned of severe cuts in government services as a result of the reductions, few, if any, are likely to be felt for several weeks.

That could give the administration and lawmakers breathing room to negotiate a replacement, although Senate Republican Leader Mitch McConnell said during the day there were limits to what could be negotiated.

"We can either secure those reductions more intelligently, or we can do it the president's way with across-the board cuts. But one thing Americans simply will not accept is another tax increase to replace spending reductions we already agreed to," he said.

Democrats said their proposal to replace across-the-board cuts was designed with the economy in mind.

It "seeks the same amount of savings in a more responsible way" as the $85 billion in cuts that will otherwise take effect, said Adam Jentleson, a spokesman for Senate Majority Leader Harry Reid.

"The impact on the economy is much better. Sequestration as constituted would hurt economic growth and destroy jobs," he added.

Over a decade, the bill would cut deficits by an estimated $110 billion, half from higher taxes and half from the defense and farm program cuts.

That is in keeping with Obama's call for a balanced approach that combines selected spending cuts with closing tax loopholes.

Senate Democrats have been reluctant to spell out the details of their measure, although it is not clear if that results from its relatively small impact on the deficits through the end of the current budget year.

Across the Capitol, though, the party's leaders have talked openly of their desire to spread the cuts in their replacement measure over a longer period.

"It is entirely intentional," said Rep. Chris Van Hollen, D-Md., and the party's senior member on the House Budget Committee. "The whole idea is to achieve the equivalent deficit reduction without hurting jobs and having disruption in the economy. You do that by having targeted cuts and eliminating tax loopholes over a longer period of time," he added.

He said the Democrats' approach is the same as Federal Reserve Chairman Ben Bernanke's recommendation, which is to help the recovery gain strength before beginning to make cuts.

In the Senate, Republicans have yet to disclose their own sequester replacement measure. Most of the rank and file favors an alternative that lets Obama adjust the cuts to minimize any impact on the public, but that approach has its critics among lawmakers who fear giving the White House that much authority.

Bearded capuchin monkeys deliberately place palm nuts in a stable position on a surface before trying to crack them open, revealing their capacity to use tactile information to improve tool use. The results are published February 27 in the open access journal PLOS ONE by Dorothy Fragaszy and colleagues from the University of Georgia.

The researchers analyzed the monkeys' tool-use skills by videotaping adult monkeys cracking palm nuts on a surface they used frequently for the purpose. They found that monkeys positioned the nuts flat side down more frequently than expected by random chance. When placing the nuts, the monkeys knocked the nuts on the surface a few times before releasing them, after which the nuts very rarely moved. The researchers suggest that the monkeys may have learned to optimize this tool-use strategy by repeatedly knocking the nut to achieve the stable position prior to cracking it. They conclude that the monkeys' strategic placement of the nut reveals that the monkeys pay attention to the fit between the nut and the surface each time they place the nut, and adjust their actions accordingly.

In a parallel experiment, the scientists asked blindfolded people to perform the same action, positioning palm nuts on an anvil as if to crack them with a stone or hammer. Like the monkeys, the human participants also followed tactile cues to place the nut flat-side down on the anvil.

Ex-BP CEO makes brief cameo at oil spill trial

NEW ORLEANS (AP) ? Once the object of ridicule and focus of outrage after the 2010 oil spill in the Gulf of Mexico, BP former chief executive Tony Hayward made a cameo Wednesday at the trial over the disaster, briefly showing up on a videotape in what may be his only appearance in the courtroom.

Hayward, who famously said "I'd like my life back" at the height of the spill, isn't expected to take the witness stand in the high-stakes trial to determine how much more BP and its partners should pay for the spill. While Hayward testified before Congress and gave a videotaped deposition for this trial, his role may be limited here by his lack of direct knowledge of the drilling operations on the Deepwater Horizon.

Still, attorneys for the U.S. government and Gulf Coast residents and businesses showed a 20-minute snippet of his deposition, projecting the video on a large white screen in the courtroom. The attorneys have said the London-based company bears most of the blame for the spill and they accused the company of putting profits ahead of safety by cutting corners on a project that was over budget and behind schedule.

"I believe that the role of leaders is very important in shaping the culture of an organization," Hayward said in the videotape.

He also said cost-cutting measures in the years before the 2010 spill did not have an effect on drilling operations, comments that differed from excerpts of a videotaped deposition from Kevin Lacy, who served as BP's senior vice president for drilling operations in the Gulf before resigning several months before the spill.

Lacy said BP slashed between $250 million and $300 million from its Gulf drilling budget from 2008 to 2009 while at the same time its production rose by more than 50 percent.

"I was never given a directive to cut corners or deliver something not safely, but there was tremendous pressure on costs," Lacy said.

U.S. District Judge Carl Barbier is presiding over the trial designed to identify the causes of BP's Macondo well blowout and assign percentages of fault to the companies involved. If BP is found guilty of gross negligence, it could be on the hook for nearly $18 billion.

The rig explosion killed 11 oil rig workers and the busted well dumped an estimated 172 millions of gallons of oil into the Gulf.

Barbier listened to the videotape as a lawyer asked Hayward about a speech he gave just five days before the blowout.

Hayward spoke about the company's "drive to increase efficiency and reduce costs."

"The context was I'd spent time talking about safe, reliable operations before I talked about any of this," Hayward said.

Hayward also drew a distinction between reducing "corporate overhead" and cutting "corporate operating costs."

While the busted well spewed oil into the Gulf, Hayward was photographed at a yacht race and also accused of directing his employees to downplay the disaster to keep stock prices afloat.

Hayward told Congress he was personally devastated by the spill and that it never should have happened. He stepped down as CEO and later left the company.

Rig owner Transocean Ltd. and cement contractor Halliburton also are defendants and their lawyers have tried to minimize their roles in the disaster. BP attorneys have said the drilling was a team effort and that all of the companies share responsibility for the disaster.

Earlier Wednesday, Transocean attorney Kerry Miller questioned Lamar McKay, who was president of BP America at the time of the disaster. McKay said he personally did not know of any reason to be critical of Transocean or its crew members on the rig and acknowledged that BP still leases three rigs from Transocean operating in the Gulf.

He agreed that the Deepwater Horizon was a "very safe operating rig."

"Up until the accident, yes," McKay said.

McKay also said BP has accepted "part of the responsibility" for causing the blowout of its Macondo well.

"We have apologized for that," said McKay, now chief executive of BP's Upstream unit. "We have accepted responsibility for that in many ways."

BP pleaded guilty in January to 14 criminal counts, including 11 felony counts of manslaughter, and agreed to pay $4 billion in criminal penalties to resolve a Justice Department probe. Transocean pleaded guilty earlier this month to one misdemeanor count of violating the Clean Water Act and agreed to pay $400 million in criminal penalties.

Miller pointed out the differences between the companies' plea deals as he questioned McKay.

(AP) ? Chuck Hagel took charge Wednesday of the Defense Department with deep budget cuts looming and Republican opponents still doubtful that he's up to the job.

He took the oath of office as Secretary of Defense at the Pentagon and was expected to address civilian and uniformed employees of the department later Wednesday morning.

The bitter, seven-week fight over his nomination ended Tuesday as a deeply divided Senate voted 58-41 to confirm him. Just four Republicans joined Democrats in backing the former two-term Republican senator from Nebraska and twice-wounded Vietnam combat veteran.

"I am honored that President Obama and the Senate have entrusted me to serve our nation once again," Hagel said in a statement Tuesday. "I can think of no greater privilege than leading the brave, dedicated men and women of the Department of Defense as they perform vital missions around the globe."

Hagel promised to work closely with Congress, but he faces lingering reservations about his ability to handle the responsibilities. Shortly after the vote, Sen. Lindsey Graham said he still has serious questions about Hagel and his qualifications.

"I hope, for the sake of our own national security, he exceeds expectations," said the South Carolina Republican.

The top Republican on the Armed Services Committee, Sen. Jim Inhofe of Oklahoma, said Hagel's record on Israel, Iran, defense spending and nuclear weapons "demonstrate, in my view, a profound and troubling lack of judgment on many of the critical issues he will now be confronted with as secretary of defense."

But Inhofe promised to work with Hagel to avoid the $46 billion in automatic, across-the-board budget cuts that hit the Pentagon on Friday.

Obama alluded to the need for cooperation in his statement welcoming the vote.

The president said he was grateful to Hagel "for reminding us that when it comes to our national defense, we are not Democrats or Republicans, we are Americans, and our greatest responsibility is the security of the American people."

Hagel joins Obama's retooled national security team, including Secretary of State John Kerry and CIA Director-designate John Brennan, at a time of uncertainty for a military emerging from two wars and fighting worldwide terrorism with smaller, deficit-driven budgets.

Among his daunting challenges are dealing with the budget cuts and deciding on troop levels in Afghanistan as the United States winds down its combat presence. He also will have to work with lawmakers who spent weeks vilifying him.

Republicans insisted that Hagel was battered and bloodied after their repeated attacks during the protracted political fight.

"He will take office with the weakest support of any defense secretary in modern history, which will make him less effective on his job," said Sen. John Cornyn of Texas, the Senate GOP's No. 2 Republican.

Not so, said Democratic Sen. Jack Reed, who pointed out that Hagel now has the title and the fight is history.

"All have to work together for the interest of the country," said Reed, D-R.I.

The vote ended one of the bitterest fights over a Cabinet choice and former senator since 1989, when the Democratic-led Senate defeated newly elected President George H.W. Bush's nomination of Republican John Tower to be defense secretary. This time, Republicans waged an unprecedented filibuster of a president's Pentagon pick and Hagel only secured the job after Republicans dropped their delay.

A 71-27 vote to end the filibuster cleared the way for Hagel's confirmation.

In the course of the rancorous nomination fight, Republicans, led by Inhofe and freshman Sen. Ted Cruz of Texas, insinuated that Hagel has a cozy relationship with Iran and received payments for speeches from extreme or radical groups. Those comments drew rebukes from Democrats and some Republicans.

Sen. Carl Levin, D-Mich., the chairman of the Armed Services Committee, dismissed the "unfair innuendoes" against Hagel and called him an "outstanding American patriot" whose background as an enlisted soldier would send a positive message to the nation's servicemen and women.

Sen. Claire McCaskill, D-Mo., questioned how the confirmation process devolved into a character assassination in which Hagel was accused of "having secret ties with our enemies."

"I sincerely hope that the practice of challenging nominations with innuendo and inference, rather than facts and figures, was an aberration and not a roadmap," she said in a statement after the vote.

Salvaging a Classic: Jay Leno's 1962 Daimler SP250 Roadster

One great thing about being a car guy with a TV show and a website is that I hear from lots of people who want to sell me cars. Most are Ford Granadas?those really rare ones with the fake hubcaps?but every now and then something interesting comes my way.

Take the 1962 Daimler SP250 I'm currently restoring. The original owner, a man named William Brzozowski, lived in Baltimore and never garaged the car. It sat outside in the snow and the rain for 40 years. Bob Brzozowski,? William's nephew, inherited the car when his uncle died. He ?wanted to restore it but didn't have the room at his place in upstate New York, or the ?money. He contacted me, we talked a lot, and I offered a very fair price, considering that the car hadn't run in 10 years and would need pretty much everything. Buying a vehicle sight unseen is a cardinal sin for car enthusiasts, so you can consider? me the president of the More Money Than Brains Car Club. But this SP250 intrigued me: It had wire wheels and a removable hardtop, both rare accessories.

When I was growing up in Massachusetts, everybody had a four-door Ford or Chevy. I remember going to the local bowling alley and seeing a red SP250 and thinking, what a weird-?looking car. It had tiny fins, bug-eye headlights, and an oval grille that earned it the nickname the Angry Catfish. But it had a peppy little 140-hp 2.5-liter Hemi V-8 engine that was designed by Edward Turner, the famous BSA motor?cycle engineer.

When the car first appeared in the U.S. in 1959, at the New York Auto Show, it was called the Daimler Dart. But Dodge was already using that name, so Daimler quickly swapped in the much snappier SP250. At a time when most English sports cars had drafty side curtains, the SP250 had roll-up windows. Even better, it weighed only about 2200 pounds, had four-wheel disc brakes, and could top out at almost 125 mph. But sales were never good: Just 2848 SP250s were made, in three series, before they were discontinued in 1964. About 500 of them ended up in the U.S., so they're rare.

After buying the car, I had it shipped from upstate New York to my Big Dog Garage in Southern California, where the first thing we did was check for bugs. Here's why: When I was in high school, I had a Hudson Hornet that I let sit outside all winter. That spring, when it wouldn't start, I got under the dashboard to try to find out why and was immediately stung by a bunch of bees. I got some bug spray and doused the entire vehicle. A week later, I slid under the car and a garden snake landed on my chest, which scared the hell out of me. Luckily, the SP250 was filled only with spiders and ants. So we covered it in plastic, fumigated it with cans of Raid, and let it sit for three weeks.

Like I said, the car didn't run, but that was fine with me. If you have to restore the engine and wiring anyway, why pay for the fact that it's working? A running car might cost $10,000 more than something that hasn't been ?started in 25 years.

The good news was that the car itself was in pretty good condition. There was one little issue with the frame, where it had been backed into something, but the fiberglass body was fine. And there wasn't any rust.

Whenever you take a car apart, it's essential to photograph every piece as you go along. If you don't meticulously document a car with pictures when you start a restoration, you'll never be able to put it back together. At my garage, we shoot pictures of everything and store them in the computer. In the old days, you had to run down to the photo mart and wait for your pictures to be developed. That was a pain in the neck. Now you can take thousands of images, and it doesn't cost anything. So there's no excuse not to catalog.

But you don't take everything apart all at once. You just want to disassemble whatever you're working on first. The nice thing about body-on-frame cars like the SP250 is that it's easier to handle each section separately. With the exception of the hood, the trunk, and the doors, the fiberglass body comes off as one piece, so somebody else can work on it while you're working on the frame.

Once we start the restoration, the first thing we like to do is to get the vehicle back on four wheels. Before we start working on the engine or the transmission, we restore the chassis. Then we can roll it around the garage if we need to move it. As of this writing, we've straightened and powder-coated the frame. It's always helpful to have the original factory manuals, if you can find them, but this car is pretty straightforward. A lot of the worn-out parts are universal British components, stuff that you'd find in a Triumph TR3 or an Austin-Healey. The only thing that really makes the SP250 unique is that little V-8. And I can't wait to get my hands dirty taking that apart.

We've also carefully sanded, primed, and repainted the body. It was red, but we did it over in blue. Most SP250s that I've seen are either green or red, so I wanted something that really stood out. Stitch Corp., my upholsterer, has already measured the interior for new seats and carpeting. Whenever they finish installing their work, we'll mount the body on the frame and complete the wiring and plumbing.

We also plan to make a few improvements: bigger front disc brakes, rack-and-pinion steering, a T5 transmission, and radial tires. We can always change it back to standard, but it will drive and stop a lot better with these upgrades. We'll breathe on the engine a little, too, with higher compression, lightweight pistons, a hot cam if we can find one, electronic ignition, and maybe bigger carburetors.

People ask me if there's a timetable for completion. Look, a car restoration is not like some Stalin-era five-year wheat plan. When it's done, it's done. A lot depends on how long it takes us to find all the missing stuff. But in the meantime, it's a lot of fun to see a dusty, bug-ridden hulk coming back to life. And when the job is complete, Bob Brzozowski is going to come out to California to go for a ride with me. I think he'll be pleased.

The Engadget Show 41 'Space' with NASA, SETI, Liftport and Mary Roach

"Space," a great man once said, "is the place." Over the centuries, the cosmos have inspired mankind's imagination and innovation, in pursuit of that final frontier. The past few decades, however, have seen a fading of such romantic pursuits, a phenomenon no better illustrated than with the end of NASA's shuttle program. So, where does that put us in 2013? This month, we travel the country in pursuit of an answer, speaking to some of the top minds in the public and private space games.

We kick things off with a profile of LiftPort, a commercial space endeavor operating out of a small garage in rural Washington State that has been funding its dreams of space elevators through crowdfunded Kickstarter campaigns. Next, we head out to Cape Canaveral in Florida, where Swamp Works has set up shop in an old Apollo training facility. NASA scientists will tell us about some of the organization's far-out plans for getting to Mars and back and 3D printing structures on lunar and planetary surfaces once we arrive.

NASA's Tom Rivellini joins us to discuss "seven minutes of terror," and what it takes to land a rover on the surface of Mars. We'll also pay a visit to NASA's Ames facility to discuss why space travel is still important to life on Earth. And while out in the San Francisco Bay Area, we swing by the SETI institute to find out how the organization is actively looking for extraterrestrial life in the universe, including a discussion with SETI founder and developer of the Drake Equation, Frank Drake.

Next up, things get a bit animated with Packing for Mars author Mary Roach, who will discuss the grosser side of manned space travel, while professional prognosticator (and sometimes rock musician) John Roderick kicks off his new reoccurring segment by explaining how space exploration helps him get out of bed in the morning.

We also take a closer look at how the commercial space sector is pushing exploration forward with Google Lunar X Prize senior director, Alexandra Hall, a lunar rover team at Carnegie Mellon, the Space Angels Network VC firm and Laser Motive, which is working on powering crafts through lasers. Qualcomm bolsters AllJoyn functionality, demos LTE carrier aggregation with 150Mbps peak transfers

Peak transfers of 150Mbps, you say? We're listening. Here at Mobile World Congress, Qualcomm's newest Gobi chipsets (the MDM9225 and MDM9625) are the first to support LTE carrier aggregation and LTE Category 4 with peak data rates of up to 150Mbps. The reveal marks the introduction of the outfit's third-generation 4G LTE embedded chip, and if all goes well, we should see the hardware slipping into phones, tablets and potentially laptops in the second half of 2013. To make it all seem more realistic, it partnered with Sierra Wireless and Ericsson here in Barcelona in order to prove the figures. For those unaware, LTE carrier aggregation combines radio channels within and across bands to increase user data rates and reduce latency -- in other words, it allows LTE to be even faster.

In related news, Qually also announced that it'll be extending the AllJoyn software development project with "new core interoperable services." As of now, we're simply told that the new services will be available on devices with different operating systems and from different vendors, theoretically enabling an "Internet of Everything" by the time they're upstreamed into the AllJoyn open source project by May 2013. We'll be swinging by the company's booth to see what exactly there is to visualize -- for now, feel free to pursue the press releases linked below.

Severance agreements: Beware new legal risks ? Business ...

If your severance packages to departing workers include a waiver of future potential lawsuits, that?s a smart strategy. But be aware that small mistakes with severance packages?especially for older workers?can lead to big problems in court. Here are two recent lessons learned in the courts:

Lesson 1: Give employees time

Following a dispute with a lab technician, Columbia University in New York offered a deal: The worker would resign in exchange for a small severance payment and compensation for unused vacation leave.

The university gave him an hour to consider the offer, which had been negotiated with the help of a local union rep. The employee accepted the terms, but later regretted signing. He sued, saying he?d signed the severance under duress. The court let the case go to trial, noting the short time and the fact that he didn?t have access to an attorney. (Mandavia v. Columbia University)

Note: To comply with age bias laws, you should give employees at least 21 days to consider severance packages that include waivers of age discrimination lawsuits.?

Lesson 2: Sweeten the deal

Another requirement for severance waivers of age discrimination claims: They?re only valid if the agreement gives the departing worker more money (or some other benefit) than they would otherwise receive if they didn?t sign the deal.

That?s why any severance packages must be crystal clear about the basis of extra payments?and what the employee would get if he or she didn?t sign. ?

Example: When Charles was laid off from Motorola, he signed a severance agreement that gave him $80,000 in exchange for promising not to sue. He sued anyway, arguing that it wasn?t clear whether he would have received the same amount even if he didn?t sign the lawsuit waiver.

The court said the case could go forward. Motorola will have to show how the payment compares to what Charles would have received if he didn?t sign. (Lamberti v. Motorola Solutions)

Final tip: Severance agreements aren?t do-it-yourself projects. Get your attorney?s help, especially if the employees involved are over age 40.

Age discrimination: 6 parts of a legal severance waiver

Severance packages must conform to the Age Discrimination in Em??ploy??ment Act (ADEA) and its companion law, the Older Workers Ben??efit Protection Act (OWBPA). Together, the laws dictate how you can legally ask employees to waive their rights to sue. When asking employees to waive their rights to age discrimination lawsuits, the waiver must:

  1. Be in writing and be understandable.
  2. Specifically refer to the ADEA rights or claims.
  3. Not waive rights or claims that may arise in the future.
  4. Be provided in exchange for other consideration.
  5. Advise the person in writing to consult an attorney before signing.
  6. Provide the person at least 21 days to consider the agreement and at least seven days to revoke the agreement after signing it.

It's back! New Jeep gets an old name: Cherokee

Chrysler is turning to an old name for a brand new Jeep. Say farewell to Liberty. The replacement model that will added to the line-up for 2014 will be rechristened the Jeep Cherokee, reviving a nameplate that helped kick off one of the most dramatic transformations in modern automotive history.

Jeepisn?t saying much beyond describing the 2014 Cherokee as an ?all-new, ?no-compromise?? vehicle that will set ?a new standard with even more best-in-class capability, exemplary on-road driving dynamics, and fuel economy improvements of more than 45% versus the outgoing mid-size SUV model.?

The new mid-size sport-utility vehicle will make its formal debut at the upcoming New York Auto Show. The 2014 Jeep Cherokee will be assembled at Chrysler?s big Toledo Assembly Plant a half-hour south of Detroit, the same factory that produced the old Jeep Liberty.

A quick look at the styling suggests the automaker wanted a more modern and distinctive look, with design cues clearly borrowing from the Jeep brand?s flagship sport-utility model. But this is more than just a ?baby? Grand Cherokee.

Observers and company insiders alike say Jeep is taking a risky approach with the front end, in particular, which features a folded take on the brand?s familiar, 7-slot grille, as well as distinctive split headlight and foglamps.

Company officials have hinted that the new model will focus less on the traditional, go-anywhere capabilities associated with Jeep products, putting more emphasis on the on-road ride and comfort that today?s ute buyers prefer.

The old Liberty model was a ?niche part? of an SUV market that has ?moved on? from its original focus on off-roading, said Mike Manley, CEO of the Jeep brand.

The Jeep marque was a major factor in the explosive growth of the sport-utility segment during the 1970s, ?80s and ?90s, the launch of the original Cherokee in 1974 creating a surge in demand as U.S. buyers looked for more enticing alternatives to their traditional sedans and wagons.

The early version ? which remained in production through 2001 ? also helped introduce the concept of four-wheel-drive to a more mainstream audience. Today?s newest all-wheel-drive systems are becoming increasingly common on conventional sedans and even sports cars, as well as SUVs.

And on the car-based crossover-utility vehicles that have largely supplanted more traditional, truck-based sport-utes. CUVs often sacrifice the off-road capabilities in favor of better on-road manners and improved fuel economy. But the unibody design of the big Jeep Grand Cherokee shows that it is possible to meld off- and on-road capabilities in one vehicle.

The new 2014 Jeep Cherokee is being seen as a critical part of the brand?s global growth plans. Long focused on the North American market, Fiat/Chrysler CEO Sergio Marchionne has declared the Jeep brand one of a handful of marques that will be sold worldwide.

The reborn Cherokee will likely play a critical part of that, along with the latest updated of the Jeep Patriot and Compass models and an even smaller crossover that the maker plans to produce in Italy. The Grand Cherokee is also getting an early mid-cycle update for 2014, along with the addition of a new, high-mileage diesel engine.

But Jeep isn?t focusing only on downsized models. The marque also is rumored to be developing a larger ute that could bring back another once-popular nameplate, that of the old Grand Wagoneer.

With the addition of the Liberty and the Compass and Patriot updates, CEO Marchionne is hoping to boost Jeep sales to around 800,000 by 2014, up from 701,626 in 2012 ? which was the brand?s best year ever.

The grapevine was right, Chrysler is bringing back the Jeep Cherokee.

The mid-size SUV that?ll be called Cherokee ? slotted below the Grand Cherokee in the lineup ? will be unveiled at the New York International Auto Show next month as a 2014 model.

Chrysler says Cherokee will be built at its Jeep factory in Toledo, Ohio and will go on sale the third quarter this year.

Cherokee, a boxy and sturdy utility with off-road credibility, was the brand?s well-known SUV for more than two decades until it was replaced by Liberty in the U.S. starting in the 2002 model year (Chrysler, confusingly, also sold the Liberty under the Cherokee name elsewhere in the world)..

Now the pendulum swings back, and Cherokee will supplant the Liberty here.

No specifics on power, size, price, mileage, but the automaker says it will be a ?no compromise? vehicle and will have mileage improvements of more than 45% vs. the current Liberty.

Firefighters from D.C.'s Fire and Emergency Medical Service Department are feeling the heat for appearing with President Barack Obama during a press event on Tuesday.

Three local firefighters are facing possible disciplinary action after appearing with President Barack Obama during a press event.

Earlier this week the president was flanked by first responders as he spoke about the impact of sequestration. Kenneth Ellerbe, chief of D.C.'s Fire and Emergency Medical Service Department, told NBCWashington.com the three members of DCFEMS who participated in the event may have violated department regulations.

"I didn't know about it, the deputy mayor didn't know about it, the mayor didn't know about it," Ellerbe said. "There should be protocol followed anytime one of our employees representing the District of Columbia appears at a public event."


Ellerbe says the three have each been ordered to file a special report on the event detailing how they came to appear with the president and who authorized it.

"How did they get there, why were they there and why didn't we know about it before?" Ellerbe said.

Ed Smith, president of Local 36 of the firefighters union, said his office facilitated the appearance by the firefighters. "The request came through the International Association of Firefighters," Smith said, adding that it's not the first time D.C. firefighters have been asked to appear with the president.

But he said, it's the first time it's been an issue. "We've done this before. I would hope it doesn't come to any discipline. They were supporting our president," he said.

Ellerbe would not identify the department members involved, but one of those pictured is Lt. Robert Alvarado, who has been disciplined in the past by Ellerbe. In 2012, Alvarado was placed on leave after he wore a uniform with an outdated logo.

Ellerbe says requiring Alvarado and the others to explain why they attended the event in their dress uniforms is not payback for any previous incidents.

"There's no payback, we don't operate in a payback environment. I know folks say that but it's not true," Ellerbe insisted.

Ellerbe says none of the firefighters are facing termination, but added one of those involved is a woman who is new to the department and still on a probationary period.

(AP) ? Back on the court after days of mourning, the Los Angeles Lakers grinded out a gritty win thanks to a vintage performance from their biggest star.

Kobe Bryant scored 40 points, Dwight Howard had 19 points and 16 rebounds, and Los Angeles capped a trying week with a 111-107 victory over the slumping Portland Trail Blazers on Friday night.

Hours after longtime Lakers owner Jerry Buss was buried, and a day after a moving memorial service punctuated by eulogies from Bryant and other franchise greats, the team got back to basketball with a much-needed victory at Staples Center.

"It's been a tough week," Howard acknowledged. "But as a team and a city and an organization, we're coming together. And it's great. We need all the support we can get from our fans, and the Buss family needs the support from us. So we're getting there. You could see the effort and emotion that we have on the court."

During his eulogy, Bryant publicly challenged his teammates in the audience to win a championship in Buss' memory ? even though the Lakers are 3? games behind Houston for the final Western Conference playoff spot with 26 games remaining.

"Kobe said what he had to say. But as a team, we understand how important the second half of the season is for us and what we want to accomplish," Howard said. "We've had a lot of ups and downs this year, and we want to do whatever we can to get this right. Kobe and myself understand that. It starts with me and him, as far as being on the same page. And on defense, it starts with me."

Bryant scored 11 points in the final 5? minutes as the Lakers won for the seventh time in 10 games.

Antawn Jamison had 16 points off the bench, helping to hand Portland its season-worst seventh straight loss. The Trail Blazers have lost five consecutive road games and 10 of their last 11 away from the Rose Garden, leaving them 11th in the conference standings.

Portland led 82-80 after three quarters, and the lead changed hands 11 times before Steve Nash's layup gave the Lakers a 107-105 lead with 1:44 to play. Bryant fumbled the ball out of bounds on the Lakers' next possession, but the Blazers couldn't capitalize and Bryant closed it out with four free throws in the final 13 seconds.

Bryant finished 9 for 9 from the line and 15 of 23 from the floor, but still called it "somewhat of an off-shooting night."

"I had to be a little bit more assertive ? but at the same time make plays for my team," said Bryant, who committed five turnovers. "I've been having off-shooting nights for the last month. We just need to continue to focus and approach every game like it's a playoff game."

Howard, looking for his sixth rebounding title in seven seasons, came in averaging an NBA-best and career-high 11.8 boards per game. The Lakers are 19-12 when he gets double digits in rebounds, and 11 of those losses have come on nights when he grabbed 14 or more. They wasted 26 boards in a home loss to Denver on Jan. 6, and 20 in a Dec. 11 loss at Cleveland.

"I think a lot of us are playing a lot harder. I know for myself, I'm in better shape now and I'm able to do more. So that's going to get better," Howard said. "I think I have to really come out every night with the same intensity and the same effort. I have to do a better job of playing hard, and I'm going to try."

J.J. Hickson had 22 points and 11 rebounds for Portland, and Nicolas Batum also scored 22. Two-time All-Star LaMarcus Aldridge finished with 15 points in 34 foul-plagued minutes after picking up his fifth personal with 8 minutes remaining.

Damian Lillard added 19 points. All of Portland's starters scored in double figures, while the bench produced just 14.

Hickson, who came in fifth in the NBA with a 56.5 field goal percentage, shot 8 for 10 in the first half and had 16 points ? including a 20-footer with 2.6 seconds on the clock to give the Blazers a 55-53 lead at the break.

"I like the way our team fought," Portland coach Terry Stotts said. "We've had a rough stretch, but we came out and played aggressively. We pushed the tempo and did a lot of good things out there. I thought we played well enough to win the game, but unfortunately we didn't."

NOTES: The Lakers (27-29) haven't been under .500 this deep into a season since 1993-94, when they were 21-35 after 56 games and finished 33-49. That was the first of only two times that the team didn't make the playoffs during Buss' term as owner, which began in 1979-80. ... The Lakers are 5-13 when Bryant commits five or more turnovers. ... Bryant hit a 3-pointer in the first quarter that snapped his string of 16 consecutive misses from behind the arc. He is only 2 for 39 since Jan. 20, when he misfired on his last two attempts. "I didn't realize I was shooting so poorly from the 3," Bryant said. "It was one of those things where I was facilitating and taking a 3 here and there, a 3 here and there. All of a sudden, it adds up. It just irked me it's not going down." ... Hickson was 11 for 15 from the field, extending his club-record streak to 18 consecutive games of shooting 50 percent or better. ... No Lakers player scored 30 or more points in the team's previous 17 games since Jan. 15, when Bryant and Howard each had 31 in a 104-88 home win against Milwaukee. ... The Blazers haven't lost more than seven straight games in the same season since 2005-06, when they dropped their final eight and 19 of their last 20. They begin a four-game homestand Sunday against the Celtics, who have beaten Portland six straight times and won 13 of the past 14 meetings. ... The Blazers have lost six straight road games against the Lakers, and are 5-20 against them at Staples Center since the arena opened in 1999-00.
