Dentist who used paper clips gets year in jail

(AP) ? A former Massachusetts dentist was sentenced to one year in jail Monday for using paper clips instead of stainless steel posts in root canals.

Dr. Michael Clair pleaded guilty earlier this month to a list of charges, including assault and battery, defrauding Medicaid of $130,000, illegally prescribing medications and witness intimidation.

Prosecutors said Clair sometimes used sections of paper clips when performing root canals in an effort to save money. Some of his patients reported infections and other problems.

Brenda Almeida said her teenage son's tooth turned black and had to be removed after Clair performed a root canal on him in 2005. She said Clair also performed shoddy dental work on her other two children.

Almeida, who watched Clair get sentenced in Fall River Superior Court Monday, said she was angry about what she considers to be a light sentence.

"He put my kids in pain for months ... I hope he rots there," she said after Judge Richard Moses sentenced Clair to a year in the Bristol County House of Correction.

Prosecutors, who asked for a sentence of five to seven years, declined to comment immediately after the sentence was imposed.

Clair, who had a dental practice in Fall River, now lives in Crofton, Md.

The judge said he considered Clair's acceptance of responsibility, lack of a criminal record and "certain mental health issues" Clair is dealing with in deciding on the one-year sentence. He did not give any specifics on the mental health issues.

Clair's lawyer, John Dingee, declined to comment.

Moses granted a request from prosecutors to order Clair to stay away from his victims and seven people who worked in his office. Assistant Attorney General Toby Unger said Clair's former staff members "have expressed concern for their safety," but did not elaborate.

Moses sentenced Clair to 2? years, with all but one year suspended, followed by five years of probation.

Clair did not speak during the sentencing, except to thank the judge.

"Thank you, your honor, for your consideration," he said.

Clair's license to practice dentistry was suspended in Massachusetts in 2006. A spokesman for Attorney General Martha Coakley said Clair is no longer licensed to practice dentistry in any state.

Prosecutors said Clair was suspended by Medicaid in 2002, but continued to file claims from August 2003 to June 2005 by using the names of other dentists in his practice.

The Clean Up Process
The Overview screen opens by default when the program is launched, and it's where the "Analyze Now" button lives. Clicking the arrow next to it opened drop-down box that presented two choices: "Perform Quick Analysis" and "Perform Deep Analysis." The former is a one- to two-minute scan that looks for the most common PC problems; the latter is a five- to seven-minute scan that checks for all problems. Considering the heavy use that our test laptop had received, I went with the second option. Approximately six minutes later finished the scan and uncovered over 2,000 problems.

Beneath the reading appeared a highlighted message: "Boost speed and stability by removing redundant programs with CRUDD Remover." CRUDD is Iolo's acronym for Commonly Redundant or Unnecessary Decelerators and Destabilizers?fancy talk for duplicate programs that clog your system. The idea behind CRUDD Remover is to eliminate those extra programs as each application install theoretically slows your PC's performance a bit. After running CRUDD Remover, 9 problems were detected on the PC, which were explained in wonderful detail on the "Problems" screen.

Program Accelerator took approximately 15 minutes for to work its magic, and, when it was done, I discovered that it had re-aligned over 30,000 files and eliminated nearly 100 file fragments. Four further files were defragmented after a restart.

Performance Improvements
I tested Iolo System Mechanic 10.7's ability to whip a PC back into shape by performing three tests?running the Geekbench system performance tool, measuring boot times, and transferring a 1.1GB folder of mixed media to external storage?before and after running the software to compare the computer's potency. Each test was run three times and averaged. Before AVG PC Tuneup 2011 scrubbed the system, the 2-GHz Intel Core i7 X990 Style-Note notebook with 4GB of RAM, and an 80GB Intel SSD drive achieved a 5,903 Geekbench score, booted in 50.3 seconds, and transferred the 1.1GB folder in 40.5 seconds.

After using Iolo System Mechanic 10.7, the system saw the most improved performance of all the tune-up utilities tested: The GeekBench score rose to 6064 (better than TuneUp Utilities 2012's 6045); the boot time decreased to just 37.1 seconds (on a par with TuneUp Utilities 2012's 37 seconds). Frenchman killed in armed robbery in Red Sea resort (Reuters)

CAIRO (Reuters) ? A Frenchman was killed when armed men raided a currency exchange office Saturday in the Egyptian tourist resort of Sharm el-Sheikh on the Red Sea, security officials and the French embassy said.

South Sinai Governor General Khaled Fouda told Reuters that a German national had also been wounded but was in a stable condition in hospital.

The French embassy confirmed a Frenchman had been killed without giving further details.

Sharm el-Sheikh is on the Sinai Peninsula, home to many popular tourist resorts. However, many people own weapons in inland areas of the peninsula, and analysts say the region has become more lawless since an uprising ousted President Hosni Mubarak last year.

GOP insiders rise up to cut Gingrich down to size (AP)

ORLANDO, Fla. ? Republican insiders are rising up to cut Newt Gingrich down to size, testament to the GOP establishment's fear that the mercurial candidate could lead the party to disaster this fall.

The gathering criticisms are bitingly sharp, as if edged by a touch of panic, a remarkable development considering the target once was speaker of the House and will go down in history as leader of the Republicans' 1994 return to power in Congress. The intended beneficiary is Mitt Romney, a once-moderate Massachusetts governor whom many rank-and-file Republicans view with suspicion.

"The Republican establishment might not be wild about Mitt Romney, but they're terrified by Newt Gingrich," said Dan Schnur, a former GOP campaign strategist who teaches politics at the University of Southern California.

The anti-Gingrich statements have come from conservative columnists, talk show hosts including Ann Coulter, former Reagan administration officials and others. One of the harshest was written by former Sen. Bob Dole, the party's 1996 presidential nominee.

"I have not been critical of Newt Gingrich but it is now time to take a stand before it is too late," Dole wrote in the conservative magazine National Review. "If Gingrich is the nominee it will have an adverse impact on Republican candidates running for county, state, and federal offices."

As speaker from 1995 through 1998, Gingrich "had a new idea every minute and most of them were off the wall," Dole wrote. He said he struggled against Democrats' TV attacks in his 1996 campaign, "and in every one of them, Newt was in the ad."

Gingrich has reacted unevenly to the accusations, sometimes denouncing them, other times wearing them like a badge of honor.

"The Republican establishment is just as much as an establishment as the Democratic establishment, and they are just as determined to stop us," he told a tea party rally Thursday in central Florida.

The crowd cheered. But lingering near the back was an example of how the Romney campaign is taking advantage of the whacks at Gingrich: GOP Rep. Jason Chaffetz of Utah. Chaffetz is beloved by many conservatives, and he goes from one Gingrich event to another to tell reporters why he thinks Romney would be a stronger challenger against President Barack Obama in the fall.

Gingrich aide R.C. Hammond confronted Chaffetz on Friday at an event in Delray, Fla., noting that some Republican officials criticize such shadowing tactics. Chaffetz defended his presence, saying Gingrich has vowed to show up everywhere Obama campaigns this fall, if several hours later.

Romney has drawn other high-ranking surrogates, with mixed results. South Carolina Gov. Nikki Haley annoyed some of her tea party supporters when she campaigned throughout her state for Romney, who lost to Gingrich by 12 percentage points.

It's unclear whether the anti-Gingrich push is driving a new wedge between establishment Republicans and anti-establishment insurgents such as the tea partyers.

"We don't like the Republican establishment anyway," said Mark Meckler, a Californian and co-founder of Tea Party Patriots. He said tea partyers are heavily focused on state and local races, and are wary of getting drawn into the presidential quarrels.

After all, Meckler said, "it's not as though Newt Gingrich hasn't been part of the Republican establishment."

Many other conservative activists also noted Gingrich's long history as a Washington insider, including 20 years in Congress and 13 as a well-paid consultant, writer and Fox News commentator. His history complicates his efforts to rally angry, working-class Republicans who feel that an "elite" cadre of officials, journalists and others look down on them.

"He's in one sense attacking the establishment he says he helped lead," said John Feehery, a former top House GOP aide who contends the tea party's influence is often overstated. The chief complaints about Gingrich focus more on his personality than his politics, which are hard to nail down, Feehery said.

The most damaging criticisms have come from former friends and colleagues who worked closely with him in Congress. It's Gingrich's egotistic behavior, more than ideology, that is driving the attacks, Feehery said.

Among those defending Gingrich are Sarah Palin, the 2008 vice presidential nominee who is admired by many tea partyers.

"Look at Newt Gingrich, what's going on with him via the establishment's attacks," Palin said this week on Fox Business Network. "They're trying to crucify this man and rewrite history and rewrite what it is that he has stood for all these years."

Palin and Rep. Michele Bachmann, who dropped out of the presidential race, are tea party favorites with minimal experience in Washington and in top GOP circles. Gingrich is trying to tap the sense of resentment among their followers. But his long and complicated Washington record and reputation for intra-party quarrels seem to leave some tea partyers unimpressed.

"It's truly a shame that this is where the Republican establishment has chosen to focus their energy," said Marianne Gasiecki, a tea party activist in Ohio. She added, however, that political activists should focus on congressional races. "If we have a conservative House and Senate," she said, "the power of the president is really insignificant."

As Gingrich's broadcast ads in Florida become more pointed, prominent Republicans are chiding him without endorsing Romney or any other candidates. Gingrich stopped running a radio ad that called Romney anti-immigrant after Sen. Marco Rubio, R-Fla., said it was unfair and damaging to the party.

So long as party insiders' complaints about Gingrich focus on his personality and quirks, the GOP can postpone a more wrenching debate about ideology, which may be in store if the once-moderate Romney is nominated. For now, conservative stalwarts seem determined to depict Gingrich as too erratic to be the party's standard bearer, let alone president.

Columnist Charles Krauthammer told Fox News: "Gingrich isn't after victory, he's after vengeance." He added: "This is Captain Ahab on the loose."

Some Republican voters are pushing back. "I want so badly to be for Gingrich, and I'm not going to be bullied out of my vote," said Barb Johnson, 52, who attended the tea party rally in Mount Dora, Fla., on Thursday. "I like his strong presence."

Florida's primary is Tuesday.

South Sudan, Sudan fail to agree on oil dispute (AP)

ADDIS ABABA, Ethiopia ? A South Sudan official says negotiations to end an oil dispute between South Sudan and Sudan have failed.

Landlocked South Sudan began halting oil production last week after accusing Sudan of stealing oil worth $815 million from the south.

Pagan Amum, the secretary general of South Sudan's ruling party, said late Friday that South Sudan would now "turn east" to neighbors Kenya and Ethiopia to export its oil.

South Sudan already signed a memorandum of understanding with Kenya to build a pipeline from its oil fields to Kenya's northern coast. South Sudan says it has also approached Ethiopia about a possible pipeline going to Djibouti's port.

South Sudan president Salva Kiir and Sudanese leader Omar al Bashir have been holding talks in Ethiopia.

Joe Paterno Memorial: Jay Paterno Says, 'Dad, You Won. You Can Go Home Now'

STATE COLLEGE, Pa. -- Jay Paterno leaned over his dying father, gave him a kiss, and whispered in his ear.

"Dad, you won," he said. "You did all you could do. You've done enough. We all love you. We won. You can go home now."

Joe Paterno died Sunday of lung cancer at age 85.

At a memorial service Thursday that drew some 12,000 people to the Penn State basketball arena, Jay Paterno reflected on what he called the "magnificent daylight" of his legendary father's life. It was primarily a glowing tribute to Paterno and his accomplishments during 46 years as Penn State's football coach ? but also an opportunity to defend his legacy against criticism that he failed to do more when told about an alleged child sexual assault involving one of his former assistants.

Nike founder and CEO Phil Knight won a thunderous standing ovation when he defended Paterno's handling of the 2002 allegations against former defensive coordinator Jerry Sandusky. Paterno, he hinted, had been made a scapegoat.

"If there is a villain in this tragedy, it lies in that investigation and not in Joe Paterno's response," Knight said. Paterno's widow, Sue, was among those rising to their feet.

Capping three days of mourning on campus, the 2 1/2-hour ceremony was filled with lavish praise for the man called "JoePa." Paterno racked up more wins ? 409 ? than any other major-college football coach, led his team to two national championships, and preached "success with honor" while insisting his athletes focus on academics. The Paternos donated millions to Penn State.

Though the campus and surrounding community have been torn with anger over the Sandusky scandal and Paterno's summary dismissal by the board of trustees two months before his death, Jay Paterno said his father didn't hold a grudge.

"Despite all that had happened to him, he never wavered in his belief, in his dream, of Penn State. He told me he wanted to use his remaining time on earth to see Penn State continue to thrive. He never spoke ill and never wanted anyone to feel badly for him," Paterno said.

Players from each decade of Paterno's career as the Nittany Lions' coach spoke in loving terms about their mentor, saying he rode them hard, but always had their best interests at heart and encouraged them to complete their educations and become productive members of their communities.

Among the speakers were Michael Robinson, who played for Paterno from 2002 to 2005 and flew in from Hawaii, where he was practicing for his first Pro Bowl; star quarterback Todd Blackledge from the 1980s; and Jimmy Cefalo, a star in the 1970s. Like Robinson, Blackledge and Cefalo went on to play in the NFL.

Former NFL player Charles V. Pittman, speaking for players from the 1960s, called Paterno a lifelong influence and inspiration.

Pittman said Paterno challenged his young players, once bringing Pittman to tears in his sophomore year. He said he realized later that the coach was molding him into the man he would become.

"What I now know is that Joe wasn't trying to build perfection. That doesn't exist and he knew it. He was, bit by bit, building a habit of excellence," said Pittman, now a media executive on the board of The Associated Press.

Paterno was fired Nov. 9 after he was criticized for not going to police in 2002 when he was told that Sandusky had been seen sexually assaulting a boy in the showers. Sandusky was arrested in November and is awaiting trial on charges that he molested 10 boys over a 15-year span.

As the scandal erupted, Pennsylvania's state police commissioner said Paterno may have met his legal duty but not his moral one. Penn State president Graham Spanier was also fired in the fallout.

Knight, appearing about midway through the memorial, became the first speaker to explicitly address the scandal. He said the coach "gave full disclosure to his superiors, information that went up the chains to the head of the campus police and the president of the school. The matter was in the hands of a world-class university, and by a president with an outstanding national reputation."

Lanny J. Davis, an attorney for the board, responded after the service by saying: "All the reasons for the board's difficult and anguished decision ? made unanimously, including former football players and everyone who still loves Coach Paterno and his memory ? reached a decision which was heartfelt. All 32."

"The facts speak for themselves" and include the grand jury testimony, he said.

Chris Marrone, another former player who eulogized Paterno, said Knight was his "new hero" for expressing the "pent-up frustration" of Paterno's supporters.

"I think the response that he got is indicative of how folks feel," Marrone said.

Only one member of the university administration ? the dean of the college of liberal arts ? and no one from the board of trustees spoke at the memorial, which was arranged primarily by the Paterno family.

People said it felt good to remember and celebrate the good times.

Tennessee Titans coach Mike Munchak, who played for Paterno, said he attended the service "because I'm a part of his legacy."

"It was not only about football," Munchak said. "It was about life and how he affected all of us as men."

Tired and broke, Santorum heads home to do taxes

(AP) ? Rick Santorum is tired, almost broke ? and going home.

The former Pennsylvania senator is taking a pause from Florida campaigning just days before the Tuesday primary that even he expects to deal him a third consecutive loss.

Santorum says he would rather spend his Saturday sitting at his kitchen table doing his taxes than campaigning in a state where the race for the Republican presidential nomination has become a two-man fight between Newt Gingrich and Mitt Romney.

The cash-strapped candidate acknowledges that he simply can't keep up with the GOP front-runners in Florida.

"We're going to talk about the Constitution and talk about being a strong conservative," Santorum said at an event here this week. "And that's all we can do."

Outside advisers are urging him to pack up in Florida completely and not spend another minute in a state where he is cruising toward a loss. But Santorum insisted on Friday that he would return once he has readied his taxes for public release.

"I'm coming back within 24 hours, and I'm here through up to election day," Santorum told Fox News. "I've spent every minute here in Florida, and I'm going to work in Florida."

Santorum has yet to announce his schedule for Florida's primary day. He says it was a mistake for him to remain in South Carolina on its voting day.

"We can't let grass grow," he told reporters Thursday. "South Carolina Election Day was sort of a wasted day for us."

He pledged to continue his campaign regardless of the Florida outcome.

It's a grim period for Santorum, who just three weeks ago was riding high on a strong finish in the Iowa caucuses; after first saying the result was a virtual tie with Romney, the Iowa GOP ultimately declared Santorum the winner. The victory was short-lived. He lost big in both New Hampshire and South Carolina.

He faced an uphill battle even before the race turned to Florida. He doesn't have the money to spend on television ads in Florida's expensive media markets. He couldn't compete with the thousands-strong crowds his rivals have been drawing. And he wasn't able to find a moment here that crystalized the rationale for his candidacy.

"Other candidates tell you they need your help," Santorum told Florida Republicans this week, almost pleading. "They're lying. I really need your help."

But help didn't come ? at least in this state ? for a candidate who is visibly exhausted and running on, at most, four hours of sleep each night.

So Santorum is going home to Pennsylvania, which he represented in the Senate, and Virginia, where he lives with his wife and seven children, to get some rest and, he says, prepare his own taxes. He also plans fundraisers in both states as he works to rebuild his campaign account to pay for upcoming contests in Missouri, Minnesota and Colorado.

Santorum also is looking at Arizona and Michigan, states that vote at the end of February ? if he makes it that far.

His inner circle of advisers is looking at the campaign checkbook. They say they can keep a lean campaign rolling in case Gingrich or Romney implode.

"This race is just starting. It's a three-man race," Santorum insists. "We're going to be in this race for the long term."

For now, at least, polls show Santorum dramatically trailing in Florida, the largest and most diverse state in the early nominating schedule. And he seems to be coming up short as he tries to win over voters with his everyman persona.

"I wish he had a little more passion in the belly," said Don Waldt, a Punta Gorda retiree who attended a Santorum rally at dusk this week. "He is conservative and authentic. But he isn't on top and doesn't seem to have a clear path to the top."

Millions now manage aging parents' care from afar

(AP) ? Kristy Bryner worries her 80-year-old mom might slip and fall when she picks up the newspaper, or that she'll get in an accident when she drives to the grocery store. What if she has a medical emergency and no one's there to help? What if, like her father, her mother slips into a fog of dementia?

Those questions would be hard enough if Bryner's aging parent lived across town in Portland, Ore., but she is in Kent, Ohio. The stress of caregiving seems magnified by each of the more than 2,000 miles that separate them.

"I feel like I'm being split in half between coasts," said Bryner, 54. "I wish I knew what to do, but I don't."

As lifespans lengthen and the number of seniors rapidly grows, more Americans find themselves in Bryner's precarious position, struggling to care for an ailing loved one from hundreds or thousands of miles away.

The National Institute on Aging estimates around 7 million Americans are long-distance caregivers. Aside from economic factors that often drive people far from their hometowns, shifting demographics in the country could exacerbate the issue: Over the next four decades, the share of people 65 and older is expected to rapidly expand while the number of people under 20 will roughly hold steady. That means there will be a far smaller share of people between 20 and 64, the age group that most often is faced with caregiving.

"You just want to be in two places at once," said Kay Branch, who lives in Anchorage, Alaska, but helps coordinate care for her parents in Lakeland, Fla., about 3,800 miles away.

There are no easy answers.

Bryner first became a long-distance caregiver when, more than a decade ago, her father began suffering from dementia, which consumed him until he died in 2010. She used to be able to count on help from her brother, who lived close to their parents, but he died of cancer a few years back. Her mother doesn't want to leave the house she's lived in for so long.

So Bryner talks daily with her mother via Skype, a video telephone service. She's lucky to have a job that's flexible enough that she's able to visit for a couple of weeks every few months. But she fears what may happen when her mother is not as healthy as she is now.

"Someone needs to check on her, someone needs to look out for her," she said. "And the only someone is me, and I don't live there."

Many long-distance caregivers say they insist on daily phone calls or video chats to hear or see how their loved one is doing. Oftentimes, they find another relative or a paid caregiver they can trust who is closer and able to help with some tasks.

Yet there always is the unexpected: Medical emergencies, problems with insurance coverage, urgent financial issues. Problems become far tougher to resolve when you need to hop on a plane or make a daylong drive.

"There are lots of things that you have to do that become these real exercises in futility," said Ed Rose, 49, who lives in Boston but, like his sister, travels frequently to Chicago to help care for his 106-year-old grandmother, Blanche Seelmann.

Rose has rushed to his grandmother's side for hospitalizations, and made unexpected trips to solve bureaucratic issues like retrieving a document from a safe-deposit box in order to open a bank account.

But he said he has also managed to get most of the logistics down to a routine.

He uses Skype to speak with his grandmother every day and tries to be there whenever she has a doctor's appointment. Aides handle many daily tasks and have access to a credit card for household expenses. They send him receipts so he can monitor spending. He has an apartment near his grandmother to make sure he's comfortable on his frequent visits.

Even for those who live near those they care for, travel for work can frequently make it a long-distance affair. Evelyn Castillo-Bach lives in Pembroke Pines, Fla., the same town as her 84-year-old mother, who has Alzheimer's disease. But she is on the road roughly half the year, sometimes for months at a time, both for work with her own Web company and accompanying her husband, a consultant for the United Nations.

Once, she was en route from Kosovo to Denmark when she received a call alerting her that her mother was having kidney failure and appeared as if she would die. She needed to communicate her mother's wishes from afar as her panicked sister tried to search their mother's home for her living will. Castillo-Bach didn't think she could make it in time to see her mother alive once more.

"I won't get to touch my mother again," she thought.

She was wrong. Her mother pulled through. But she says it illustrates what long-distance caregivers so frequently go through.

"This is one of the things that happens when you're thousands of miles away," Castillo-Bach said.

Lynn Feinberg, a caregiving expert at AARP, said the number of long-distance caregivers is likely to grow, particularly as a sagging economy has people taking whatever job they can get, wherever it is. Though caregiving is a major stress on anyone, distance can often magnify it, Feinberg said, and presents particular difficulty when it must be balanced with an inflexible job.

"It's a huge stress," she said. "It can have enormous implications not only for someone's quality of life, but also for someone's job."

It can also carry a huge financial burden. A November 2007 report by the National Alliance for Caregiving and Evercare, a division of United Health Group, found annual expenses incurred by long-distance caregivers averaged about $8,728, far more than caregivers who lived close to their loved one. Some also had to cut back on work hours, take on debt of their own and slash their personal spending.

Even with that in mind, though, many long-distance caregivers say they don't regret their decision. Rita Morrow, who works in accounting and lives in Louisville, Ky., about a six-hour drive from her 90-year-old mother in Memphis, Tenn., does all the juggling too.

She has to remind her mother to take her medicine, make sure rides are lined up for doctor's appointments, rush to her aid if there's a problem. She knows her mom wants to stay in her home, to keep going to the church she's gone to the past 60 years, to be near her friends.

"We do what we have to do for our parents," she said. "My mother did all kinds of things for me."

O2 UK network security blunder exposes customers' phone numbers to websites

Phone number exposed via HTTP headers

Update: O2 says that as of 1400 GMT today it has fixed, the problem, and that "technical changes" as part of "routine maintenance" were to blame for the issue, which affected customers from Jan. 10 until today. The network's full statement is available on its official blog.

Original story: If you're browsing the web on your phone or tablet on O2 UK, then the network could be exposing your phone number to every website you visit. O2 customer Lewis Peckover recently discovered that when you're browsing over 3G on O2, your handset's phone number is often included in the HTTP headers sent to each website you visit, in plain text.

HTTP headers are information exchanged between your browser and the web server before a page is loaded. In theory, the way O2 includes your phone number -- alongside more mundane information like your IP address, browser and OS -- means that any website you visit could easily find out your number. It's worth pointing out that the header used by O2 to send phone numbers -- "x-up-calling-line-id" -- isn't one that's routinely logged by web servers. However, just a couple of lines of code would allow a malicious server to find your phone number just by having you visit a website over 3G.

Lewis Peckover has set up a site to allow O2 customers to see whether they're affected. We've tried this with an O2 SIM in our Galaxy Nexus, and sure enough, there our phone number was in the list of "headers received". If you're on O2, make sure you've got Wifi disabled on your device, then click here and see if you spot your phone number among the HTTP headers. For what it's worth, early reports indicate that not all O2 customers are affected, though a large proportion apparently are.

This isn't an Android-specific problem, however due to the fact that it's a network-level issue, it'll affect Android phones just the same as any other device that's browsing over O2's data network. For this reason, just about anything that connects via HTTP over O2's network could potentially access this information. For its part, O2 says it's "investigating" the issue, and while this is a big deal for O2 customers, the fact that this is a network-level problem should mean that a fix will be relatively quick and easy to deploy.

'30 Rock' star back at work after hospitalization (AP)

SALT LAKE CITY ? Comedian and "30 Rock" cast member Tracy Morgan is back at work in New York after a brief hospitalization in Utah, his publicist said Wednesday.

"He appreciates everyone's support and concern," Lewis Kay said in an email to The Associated Press.

The actor was hospitalized Sunday while attending the Sundance Film Festival in Park City, where the elevation is 7,000 feet.

Kay said Morgan suffered from exhaustion and altitude. Morgan also has diabetes.

Morgan posted a comment on Twitter from the hospital Monday, saying the high altitude "shook up this kid from Brooklyn."

"Superman ran into a little kryptonite," he quipped.

The hospital found no drugs or alcohol in Morgan's system, Kay said.

Recordings of 911 calls made on the night he collapsed, which were obtained by the AP, indicate Morgan passed out at the Blue Iguana restaurant.

"I don't know if he's been drinking," said one caller, who added that Morgan had vomited. He also said the actor was unconscious and had been loaded into the backseat of a taxi, ready to be rushed to a hospital. However, the dispatcher told the caller to remain there and wait for an ambulance.

Other callers told the dispatcher Morgan had a high fever and was breathing slowly.

"It's actually a celebrity. He has a high fever," said one caller.

An ambulance arrived a short time later and took Morgan to a nearby hospital. He was released a day later.

Molecular structure and function of essential plant hormone could profoundly change our understanding of a key cell process

ScienceDaily (Jan. 23, 2012) ? A recent Van Andel Research Institute (VARI) study published in the journal Science investigating the molecular structure and function of an essential plant hormone could profoundly change our understanding of a key cell process, and might ultimately lead to the development of new drugs for a variety of diseases.

The study builds on earlier work by the same team of investigators at VARI that was published in the journal Nature in 2009. That study shed light on how plants respond when they are under stress from extreme temperatures, drought and other harsh environmental conditions and was later named by Science as one of the top scientific breakthroughs of 2009.

Understanding how cells talk

In signal transduction -- the basic process of intercellular and intracellular communication -- enzymes known as kinases and phosphatases serve as the opposing partners and key regulators of this process.

VARI scientists mapping the structure of the receptor for Abscisic acid (ABA), a plant hormone that controls growth, development and responses to environmental stress, discovered that ABA regulates the stress-response pathway by affecting an enzyme belonging to the phosphatase family -- which in turn binds to a kinase.

"This process has been little understood," said Karsten Melcher, Ph.D., Head of the VARI Laboratory of Structural Biology and Biochemistry and co-author of the study. "We believe that the activation mechanism may in many cases also be structural. Phosphatases inactivate the active site like a plug -- changing the shape of the kinase."

"The textbook assumption has been that enzymatic phosphatases inhibit kinases only by taking away phosphates from the kinases. There have been few recorded examples of non-enzymatic phosphatases inhibiting kinases."

Knowing that these enzymes mimic the structure of the opposing enzyme enables scientists to more accurately develop mechanisms to activate or inhibit intercellular and intracellular communication. Inhibiting or activating this process in plant cells could lead to plants that more readily survive drought or other conditions of stress.

Possible impact on the treatment of diseases

In mammalian cells the ability to impact communication has numerous and far-reaching implications. For example, applications that inhibit or activate cell communication in out-of-control metastasizing cancer cells have enormous potential to affect tumor growth.

Writing in the journal Science, where the study was published on January 6, Jeffrey Leung notes that "molecular mimicry might be a common mechanism in many biological processes involving kinase-phosphatase complexes?The structural studies on the core ABA signaling proteins establish a new paradigm for kinase-phosphatase co-regulation and coevolution."

The possibility of broader scientific implications is also noted by Melcher.

"The current studies take a step back from application and focus back on fundamental cellular mechanisms with a broad implication beyond ABA signaling," said Melcher.

In their 2009 study in Nature, Melcher and H. Eric Xu, Ph.D., used X-ray crystallography to detail precisely how ABA works at the molecular level. One of ABA's effects is to cause plant pores to close when plants are stressed so that they can retain as much water as possible.

In a follow-up 2010 study published in Nature Structural & Molecular Biology, the VARI team identified several synthetic compounds that fit well with ABA's many receptors to have the same effect. By finding compounds that can close these pores, researchers' findings could lead to sprays that use a plant's natural defenses to help it survive harsh environmental conditions. "This type of finding once again demonstrates the importance of identifying, mapping and understanding fundamental cellular and molecular processes because of the profound implications for human health," said Xu, Director of the VARI Center for Structural Biology and Drug Discovery and co-author of the current Science study.

"Proteins with similarities to plant ABA receptors are also found in humans and further studies in this area could reveal important implications for people with cellular stress disorders." The lead authors of the current Science study are Fen-Fen Soon, Ley-Moy Ng, and Edward Zhou. The project was carried out in conjunction and collaboration with scientists from the National University of Singapore, Purdue University, The Scripps Research Institute, Scripps Florida, Shanghai Institute of Materia Medica of the Chinese Academy of Sciences, the Synchrotron Research Center of Northwestern University, and University of California at Riverside.

IAEA aims to resolve "substantive issues" in Iran (Reuters)

VIENNA (Reuters) ? The U.N. nuclear watchdog Monday confirmed plans for a January 29-31 visit to Iran and said its main objective was to "resolve all outstanding substantive issues," referring to suspicions of military dimensions to the Iranian atomic energy program.

A senior International Atomic Energy Agency team is expected to seek explanations during the talks in Tehran for intelligence information indicating that Iran has pursued research and development relevant to nuclear weapons, diplomats say.

The IAEA mission will be led by Deputy Director General Herman Nackaerts, head of nuclear safeguards inspections worldwide, and will include Rafael Grossi, the assistant director general for policy.

"The Agency team is going to Iran in a constructive spirit, and we trust that Iran will work with us in that same spirit," Yukiya Amano, Director General of the Vienna-based agency, said in a statement.

"The overall objective of the IAEA is to resolve all outstanding substantive issues," the IAEA statement added, confirming for the first time the dates for the visit.

Iran's ambassador to the IAEA told Reuters last week the visit would take place from January 29-31 and that his country was open to discuss "any issues" of interest for the U.N. agency.

But Western diplomats, who have often accused Iran of using stalling tactics in the long-running nuclear dispute while it presses ahead with its atomic activities, are skeptical about the chances for major progress in the talks.

Tension between Iran and the West has increased since November, when the IAEA published a report that said Tehran appeared to have worked on designing a nuclear weapon.

Iran, one of the world's leading oil producers, says its nuclear energy program is peaceful and aimed at generating electricity.

San Jose knows its way out of housing mess

Lately economists and investors have been debating whether the housing market has hit bottom. It?s a complicated picture on a national level, but zoom in and it?s possible to identify cities that have not only reached a bottom, but are beginning to experience a recovery.

Take San Jose, Calif. The Golden State has gotten a lot of attention for its economic woes, but San Jose is a veritable oasis of prosperity. Employment in the capital of Silicon Valley is expected to expand 3.3 percent this year and it logged net in-migration in 2010 of 4,840 people. Job and population growth are fueling housing demand: New home construction in the area was up a whopping 97 percent in 2011?s third quarter compared to the year earlier.

San Jose is one of 10 metro areas that Forbes deems ripe for a real estate rebound. The folks at Local Market Monitor, a Cary, N.C.-based real estate research firm, helped us compile this list, sorting through housing and economic data for the 100 most populous cities and their surrounding suburbs, defined as Metropolitan Statistical Areas and Metropolitan Divisions by the U.S. Office of Management and Budget. LMM assessed the change in home prices over the past 12 months and three years (on the latter, our reasoning is that markets that lost less value in the housing bust have the potential to recover faster), unemployment rates, 12-month job-growth projections, the change in population from 2006 through 2009 (the most recent data available from the U.S. Census) and new-home construction rates for the third quarter of 2011 as compared to the same quarter in 2010.

All of the cities that made our list share one common factor: a relatively strong job market. ?For real estate to do well you want to see two things: that incomes are growing rapidly like they are in a market like San Jose ? and that the growth in jobs attracts other people to that market,? says Ingo Winzer, founder and president of Local Market Monitor. However, job growth should be looked at as a bullish housing indicator only if the unemployment rate is already relatively low ? that suggests local companies are creating new jobs rather than rehiring for positions they cut during the recession.

That seems to be the case in Boston. The New England hub has a low 5.7 percent unemployment rate thanks to the presence of more than 100 universities and colleges in the metro area and a variety of biotech and financial services companies. ?Income is well above average. The housing boom was mild, with a 16 percent rise in prices followed by a 10 percent drop. The recession also was mild, with jobs down just 2 percent,? explains Winzer. Clear Capital and Trulia also have positive forecasts for Beantown this year, and many of its neighborhoods graced Forbes? 2011 Most Expensive ZIP Codes list for the first time. Other college towns offering real estate promise are Austin, Texas, and Raleigh, N.C.

Oil doesn?t just heat homes, it also heats up a housing market. Cities where oil and natural gas are key components of the local economy have not only fared well in the downturn, they?ve thrived. In Houston, where the heavy concentration of energy companies has earned it the nickname ?Baghdad on the Bayou,? home prices shot up 21 percent from 2002 to 2007 and rather than falling, have stayed close to those 2007 levels since. The population has grown at nearly triple the national rate and median income is above average. Houston and other Lone Star cities also didn?t succumb to the levels of overbuilding that cities in neighboring Sun Belt states did, either.

Two surprising entrants on our list are Pittsburgh, Pa., and Rochester, N.Y., industrial-era boomtowns that went through several decades of economic decline. Pittsburgh has been one of the most stable housing markets over the past five years: Prices have been more or less flat since the market peak in 2007. Home prices in Rochester have dropped 15 percent since 2007, but its economy has managed to stabilize and hang onto jobs. Pittsburgh and Rochester "are not high-growth markets yet, and they haven?t attracted new people yet,? says Winzer. ?But they are both creating new kinds of jobs ? high-tech and medical research-related jobs ? and that?s why ? they will do better than most markets this year.?

Another city on our list that has gone through tough times is New Orleans. The Big Easy sports a relatively low 6.5 percent unemployment rate, a forecast for 1.9 percent job growth this year and a steady influx of newcomers. ?It is a really different kind of market because it is still heavily affected by what happened with Hurricane Katrina,? notes Winzer. The port city boasts an economy fueled by energy, tourism and construction. ?The real estate situation is complicated by the large number of properties destroyed. Now that the economy seems to have stabilized, renewed population growth will spur new construction.?

One of the things to remember when looking at home price data for these recovery-ready markets is that price drops or increases of one, two, or 3 percent are a pittance compared to the double-digit percentage drops common in recent years. Real estate experts like Winzer agree that price fluctuations of 3 percent or less generally indicate that a market is stabilizing. If a city hovers within that range for several quarters or a year, it?s probably safe to say that market has found its bottom. All of the metro areas on our list have almost undoubtedly found their bottoms. New home construction, which remains depressed for nearly every market across the country, should take off in these markets later in the year. ?Once these markets are truly recovering, you will see a doubling in activity,? asserts Winzer. ?It?s the last thing that happens.?

We need an executive, someone who both in private sector and as a governor, understands how to bring people together and use executive power. The speaker simply does not have that experience. But that led ?Meet the Press? moderator David Gregory to ask his guest if Gingrich?s past performance might be repeated:

GREGORY: Do you think Newt Gingrich will embarrass the party?
CHRISTIE: I think Newt Gingrich has embarrassed the party over time. Whether he?ll do again in the future, I don?t know. But Gov. Romney never has.
GREGORY: You say he has embarrassed the party. How, and where do you worry he might do it again, that makes him unelectable?
CHRISTIE: David, we all know the record. I mean, he was run out of the speakership of his own party. He was fined $300,000 for ethics violations. This is a guy that has had a very difficult political career at times and it has been an embarrassment to the party. You remember those times because you were here. So the fact of the matter is, I don?t need to regale the country with that entire list again, except to say this ? I am not saying he will do it again in the future, but sometimes the past is prologue.

Friday Campaign to Speak for Pets at MAS ? YesBiscuit!

Memphis Animal Services (MAS) is normally open only one weekend day (Saturday) which contributes to their abysmal live release rate since weekends are their greatest chance for increased traffic and adoptions.? The pound is closing this weekend for mandatory employee training on pet killing. Sunday will be the practical ? that is, killing actual pets.

It is impossible for a shelter to conduct a practical on ?humane euthanasia? for 9 hours on a designated day.? Here?s why:? Because there is no way of knowing if any pets at MAS (or anywhere) will cross over into the medically hopeless and suffering category in which humane euthanasia is warranted on Sunday.? Chances are very low that even one pet will suddenly be deemed by a vet to be medically hopeless and suffering on Sunday when there was still hope on Saturday ? never mind enough pets to fill up a 9 hour practical.? Therefore, it is impossible to conduct a day long practical on ?humane euthanasia?.? If MAS does hold this practical, what they will be doing is killing healthy/treatable pets.? That is not ?humane euthanasia? as the city is purporting the course to be.

The healthy/treatable pets who MAS is planning to kill on Sunday could potentially be adopted, fostered or rescued on Saturday if the city would keep the pound open.? I have offered to help if they would post their pets online so I could network them.? I know some of you would help too.? Further ? and I can not stress this enough ? whether or not the city opens the pound on Saturday, it is ethically wrong to kill healthy/treatable pets for a class on Sunday or for any reason, any day.

MAS kills more than 11,000 pets a year.? When will it be enough?

I say:? today.? Today is enough.

Please pick up the phone and speak for the pets at MAS who won?t be adopted this weekend but who will be killed in a practical for a killing course ? call Memphis Mayor AC Wharton at (901) 576-6000.? Politely explain that you are protesting both the closing of the pound on Saturday for a pet killing class and the needless killing of healthy/treatable pets on Sunday.? Bulgaria bans shale gas drilling

Bulgaria has become the second European country after France to ban exploratory drilling for shale gas using the extraction method called "fracking".

Bulgarian MPs voted overwhelmingly for a ban on Wednesday, following big street protests by environmentalists.

Bulgaria has revoked a shale gas permit granted to US energy giant Chevron.

Critics say shale gas drilling can poison underground water and even cause earth tremors. Industry experts say correct drilling is safe.

Hydraulic fracking involves releasing gas trapped in rocks by pumping in water mixed with sand and chemicals at high pressure. The technique is used widely in Canada and the US.

The Bulgarian drilling ban stipulates a fine of 100m levs (?43m; $66m) for any infringements.

Last Saturday protesters rallied in several Bulgarian cities urging the government to halt drilling for shale gas.

Currently Bulgaria and many of its former communist neighbours rely heavily on imported Russian gas.

Chevron had been given a permit to prospect for shale gas in northeastern Bulgaria.

Polish deposits

In Poland, shale gas and oil are seen as promising alternatives to imports of Russian energy.

A new Polish geological report says there are indications of large shale oil deposits near Warsaw, Radom (south of Warsaw) and Elblag near the Baltic coast.

The Polish daily Dziennik Gazeta Prawna says estimates of Poland's shale gas resources will be presented in March.

Polish radio says US giant ExxonMobil is best placed to take advantage of the finds. ExxonMobil has been granted shale oil exploration licences in Poland.

But the radio says Chevron's plans to drill for shale gas in southeastern Poland have met with protests in the villages of Rogow and Zurawlow.

Last June, the French parliament imposed a ban on fracking, amid pressure from environmentalists.

But the French ban does not rule out other methods for recovering shale gas or oil.

In the UK, the energy firm Cuadrilla suspended test drilling for shale gas last year after a study linked it to earth tremors.

The study also said the tremors, near the northwestern resort town of Blackpool, were due to unusual rock formations at the well site.

Environmentalists have demanded a moratorium on fracking in the UK.
