The upcoming Samsung Galaxy Note 2 is modeled on Galaxy S3 and the smartphone is likely to sport a 5.5-inch AMOLED screen and a narrower body compared to its previous version, according to?GSMArena?who received a tip from an insider.

Samsun Galaxy Note was a significant contributor to the company's ascent to the top as seven million Galaxy Note devices were sold across the globe.

The newer version is expected to be released in September, ahead of the launch of Apple's next iPhone.

Chevron Faces Asset Seizure In Brazil Over $18 Billion Ecuador Judgment, Says Amazon Defense Coalition

BRASILIA, Brazil, June 28, 2012 /PRNewswire-USNewswire/ -- Villagers from Ecuador's rainforest who won a landmark court judgment against Chevron for causing massive environmental and health damage filed suit Wednesday to seize the oil giant's assets in Brazil to generate funds to remove cancer-causing toxins and oil sludge from their ancestral homelands.

The legal action, made necessary by Chevron's refusal to comply with an $18 billion court judgment in Ecuador that was affirmed on appeal, is the second filing to force the company to pay for the clean-up of a disaster that decimated indigenous groups and caused an outbreak of cancer and other oil-related diseases that have killed or threaten to kill thousands of men, women, and children, according to various court findings in Ecuador. The villagers took their first step toward enforcing the judgment in Canada, where they filed a suit May 30th intended ultimately to garnish various revenue streams and assets held by Chevron through two subsidiaries in that country. In Brazil, they are asking the country's highest civil court to recognize the Ecuadorian judgment so seizure actions can take place.

Filed in the Superior Tribunal of Justice in Brazil's capital of Brasilia, the suit targets Chevron operations that produce a daily average of 33,000 barrels of crude oil and 13 million cubic feet of natural gas. Brazil, which has the sixth largest economy in the world, is considered a major strategic play for Chevron's long-term growth.

Bermudes founded his own law firm in 1969 and has successfully represented clients ranging from Fortune 500 companies such as Citigroup to political prisoners jailed during his country's military dictatorship in the 1970s. "I am honored to have been chosen by the indigenous peoples of Ecuador to help correct a gross violation of fundamental human rights visited upon them by Chevron," said Bermudes. "After reviewing the lengthy trial record, I have no doubt the Ecuador judgment will be enforced in Brazil."

Bermudes added: "After an eight-year trial, Chevron's extreme recklessness and the grave damage it caused to the environment in Ecuador will not be reviewed by Brazilian courts. The Superior Tribunal of Justice will only analyze whether the Ecuador decision meets the requirements of Brazilian law for enforcement of foreign judgments."

Brazil and Ecuador are signatories to a treaty that facilitates reciprocal enforcement of judgments among countries in Latin America, potentially streamlining the enforcement process and limiting the ability of a defendant to re-litigate issues already decided by the court that conducted the trial. Brazil allows interest to run on a foreign judgment during the pendency of the enforcement process, potentially adding substantial costs to Chevron should it adopt its traditional strategy of trying to delay the proceedings.

Brazil has one of the largest proven oil reserves in the world and produces 2.3 million barrels daily. The country is Chevron's second largest production market in Latin America and one of the top ten markets in the world for the oil giant's capital spending. Chevron announced in 2011 that it planned to invest an additional $3 billion in Brazil by 2014.

Chevron already faces $22 billion in possible civil and criminal penalties in Brazil related to an offshore spill and related cover-up last November in the Frade field, a $3.6 billion deep water oil project that is one of Chevron's biggest capital investments in the world. The Frade field is majority-owned and operated by Chevron, and has an estimated 300 million barrels in reserve.

Chevron also has two other significant offshore oil projects in development in the country, a large lubricant manufacturing plant, an industrial greases plant, and other smaller properties.

Pablo Fajardo, the 39-year-old lead lawyer for the Ecuadorians and the recipient of both the CNN "Hero" Award and the prestigious Goldman Environmental Prize (considered the "Nobel" of the environment), has said the Ecuador rainforest communities intend to file actions in a small number of countries to collect the entire amount of the judgment.

"We fought for almost two decades in court to win a legitimate judgment against a large American oil company that continues to treat Ecuador and its people as second-class citizens," said Fajardo, who grew up in poverty working in Ecuador's oil fields.

"While Chevron might think it can ignore court orders in Ecuador, it will be impossible for Chevron to ignore court orders in countries like Brazil and Canada where it maintains substantial assets," he added.

The judgment in Ecuador resulted from an eight-year trial that produced more than 64,000 soil and water samples that pointed to extensive contamination at hundreds of Chevron oil production sites in a large swath of Ecuador's Amazon, known as the Oriente. The area was once one of the most bio-diverse ecosystems on earth.

Fajardo said that during the trial Chevron proposed that the Ecuador court use an arbitrary clean-up standard roughly 100 times more lax than required by law in the U.S., leading to charges it was discriminating against Ecuadorians. The company also threatened one judge with a criminal prosecution, tried to bribe another judge, lied about its scientific sampling results, and reportedly offered $1 billion to Ecuador's government to quash the case. Representatives of the affected communities, who meet every two months in the rainforest in a body called the Assembly of the Affected Ones (Asamblea de Afectados), praised the filing of the action in Brazil. Citizens of Ecuador have suffered from high rates of cancer, spontaneous miscarriages, and oil-related diseases due to Chevron's substandard production practices. See here, here, and here.

"The time has come to use the force of law to make Chevron clean up its pollution," said Luis Yanza, a rainforest community leader who has been battling Chevron over the issue since the early 1990s. "No company, even one as rich and powerful as Chevron, is above the law."

The filing of the second enforcement action also comes at a time when Chevron shareholders are rebelling against company management over the risk posed by the Ecuador court judgment.

Last month, Chevron CEO John Watson suffered a stunning reprimand when investors holding over 38% of the company's shares (representing $73 billion worth of stock) voted for a resolution that directly challenged his authority because of the Ecuador case. Recently, 40 institutional shareholders representing $570 billion under management - including the New York state pension fund - urged the company to settle the Ecuador litigation.

France fights to avoid euro zone bank contagion

PARIS (Reuters) - Greece, Ireland, Portugal, Spain, Italy - France?

With a gaping public deficit and record level of debt, the euro zone's second largest economy wants to be sure it is not sucked into the bloc's game of debt-crisis dominoes, hence Paris's forceful lobbying for ways to shore up Europe's banks.

France is one of the strongest advocates of a Europe-wide banking union and, with an eye on its own banks' exposure to vulnerable debt in struggling countries, for immediate recapitalization of banks from euro zone rescue funds.

"I think the French are pushing this for a simple reason: They bloody well know they're next in line. They're after Italy," said Nicholas Spiro, head of consultancy Spiro Sovereign Strategy.

The debt crisis has already spread through Greece, Ireland and Portugal, all of which have international bailouts. Spain has asked for help for its banks. Cyprus may seek a broader bailout imminently. Italy has recently seen borrowing costs rise to dangerously high levels.

Eager to stop the snowball, France's new President Francois Hollande quickly championed ideas to fight contagion, some of which have brought him into direct opposition with Germany.

Investors are currently giving France the benefit of the doubt, driving French yields to historic lows as they seek the relative safety of debt issued by a core European country that nonetheless offers richer yields than Germany.

However, France's finances are nothing like as good as Germany's, and its banks have heavy exposure to Greece and Italy - a concern that has conditioned its response to the crisis.

"It's clear that pressure from the debt crisis will come on France and other AAA countries if there is not significant progress in mutualising risks," said Michel Martinez, Societe Generale's chief economist for France.

Spain and Italy's borrowing costs have eased somewhat on expectations that an EU leaders' summit this week will produce bold new approaches to contain the crisis. Short of that, they run the risk of becoming too costly to manage, prompting the need for sovereign bailouts.

Hollande's Socialist government has thrown its support behind the idea of setting up a banking union in Europe, with a central supervisory authority, joint deposit guarantees and a fund to wind down dud banks.

But France is also pushing for more immediate solutions that could shelter banks from the risks associated with the sovereign debt of southern Europe, fully aware that the crisis could deteriorate with lightning speed.

Paris has been a vocal supporter of using the euro zone bailout funds to recapitalize banks directly, although Germany's opposition to the idea remains a major obstacle.

DANGEROUS EXPOSURE?

Ratings agencies have said repeatedly that the prospect of Paris being forced to prop up its banks is a factor weighing against France's rating, which Standard and Poor's have already downgraded in January by one notch from AAA.

Egan-Jones, a smaller ratings agency that has made a name for itself by downgrading more aggressively than bigger rivals, cut France to BBB-plus earlier this month, partly on concerns that the state may need to support French banks.

Moreover, Moody's has downgraded French banks BNP Paribas, Societe Generale and Credit Agricole, along with other major international banks, saying it had become unclear to what degree the government was prepared to support its banks.

Apart from France's own financial stress - its gross debt is about 90 percent of gross domestic product and rising - its banks have major exposure to the euro zone's most fragile economies.

Once among the top lenders to Greece, France's banks have quietly retreated from the country. But while they no longer hold large amounts of Greek government bonds, Credit Lyonnais and Societe Generale remain present in Greece through subsidiaries.

BNP Paribas, BPCE, Credit Agricole, Societe Generale and Dexia, meanwhile, have a combined exposure of 32.5 billion euros to Italian sovereign debt. Moody's noted that BNP was exposed to Italy through its local subsidiary BNL, which has a 71-billion-euro loan book, and 11 billion euros of Italian government debt.

French bank shares and the cost of insuring bank debt have closely tracked swings in Italian government debt spreads, hinting that investors see the banks' fate tied to Italy's struggle to avoid being dragged into the eye of the debt crisis.

Dexia is the most exposed to Italian government debt, with 11.7 billion euros on its books, but even if the debt crisis does not engulf Italy, the deeply troubled municipal lender could be a big drain on French public finances.

The Franco-Belgian group, which has already required two bailouts in three years, is currently being kept afloat with 55 billion euros in guarantees from France, Belgium and Luxembourg.

However, the lender has asked for that amount to be raised to 90 billion euros - close to the 100 billion euros that Spain is seeking from euro zone partners for its entire banking sector.

"France is not out of the woods by a long shot," said Spiro, the consultant.

Facebook pulls new 'Find Friends Nearby' feature

Over the weekend, Facebook added a?stalkerish feature called "Find Friends Nearby" to its mobile website; on Monday, it was gone.

"Find Friends Nearby" let users of iOS and Android devices locate BFFs ??and perhaps nBFFs (never BFFs) ? ?who were within geographic?range. A great feature for someone you like; for someone you don't, not so much.

The add-on was part of Facebook's efforts to bolster its mobile offerings, including bringing?in more revenue, something the social network is?trying to figure out how to?achieve.

But on Monday, the feature could not be accessed.

Msnbc.com contacted Facebook about the "Find Friends Nearby" pullback.

?A spokesperson for the social network said the program was not a "formal release."

"This was something that a few engineers were testing. With all tests, some get released as full products, others don't. Nothing more to say on this for now ? we'll communicate to everyone when there is something to say."

Facebook engineer Ryan Patterson told Tech Crunch over the weekend that he built "Find Friends Nearby" ? originally called "Friendshake" ??with another engineer as part of a?hackathon.

Patterson said he saw the "ideal use case" for the product as "one where when you?re out with a group of people whom you?ve recently met and want to stay in contact with," a kind of "really easy way to exchange contact information with multiple people with minimal friction."

More sources agree on iPhone 5 micro dock connector

A few months ago, iMore reported that the iPhone 5 would have a smaller dock connector, which was in turn backed up by leaked parts. Now, TechCrunch claims three sources in the manufacturing chain are anticipating a 19-pin port on the next iOS smartphone.

Of course, even if Apple includes an adaptor like they did with the recent MacBook Retina MagSafe, that could means headaches for accessory makers. But the old 30-pin dock has been around for awhile, and whenever Apple makes a jump to the next generation, it usually involves a clean break from the past.

Aside from the metric tonne of new features in iOS 6, there's really nothing official about the next-gen iPhone that we're expecting to see in the fall. With everything still under wraps and in pre-production, there's a lot that can change in the next couple of months. That said, I would be hesitant to call anything at this point "confirmed" -- the best we have a safe bet.

With a bit more room inside, what could Apple be including on the next iPhone? LTE? NFC? More battery to power the bigger screen? What would you guys like to see the extra room being used for?

    The $900 bundle includes a Sony VAIO E 14P notebook with My Connect Studio from Boomdizzle Networks, a Web-based app that currently allows two musicians in different locations to collaborate in real time. The thin, five-pound notebook has a 14-inch, 1600-by-900-pixel display; a dual-core 2.5GHz Intel Core i5 processor; 8GB of 1600MHz memory; Window 7 Premium; and a 750GB hard disk.

    LL Cool J said that in the past if someone wanted to, for example, share a music track with him and let him record lyrics over it, the process required a lot of email traffic and delays as the music was sent back and forth.

    During a demonstration in a crowded Sony Store after the press conference, LL Cool J was able to listen to a music track mixed by someone at the other end of an Internet connection and record his voice over the song as it played, all of which was mixed at the other end. Within seconds, the remote musician played back the track, with the new lyrics smoothly mixed in.

    The key feature of My Connect Studio, said LL Cool J, is that the technology embedded in it solves all but the most microscopic latency problems, thus allowing voice or other input at one end of an Internet connection to synchronize perfectly with music being sent by the other.

    Also included in the bundle is a pair of Sony MDR-V55/BR DJ-style headphones, a one-year subscription to My Connect Studio (including ten hours per month of session time), 25 exclusive tracks, and other features. The Windows application is currently limited to two collaborators, but LL Cool J, who is a co-founder of Boomdizzle Networks, said that number will increase soon, and added that tablet and Mac versions are in the works.

    ?We?ve embraced technology to bring musicians together,? said LL Cool J, who shared the stage with fellow rap legend Grandmaster Flash.

    Thunder face tough choices after loss in NBA Finals

    OKLAHOMA CITY (AP) ? By keeping largely the same group together and building over time, the Oklahoma City Thunder climbed from the bottom of the league to the NBA Finals.

    They were so close to the pinnacle. Now it gets only more difficult to keep all the pieces in place to try to finish the job.

    The Thunder enter the offseason with coach Scott Brooks' contract about to expire, Sixth Man of the Year James Harden and NBA blocks leader Serge Ibaka eligible for new deals and the future of veterans Derek Fisher and Nazr Mohammed up in the air.

    It will be up to general manager Sam Presti to determine whether they all can still fit on a team where All-Stars Kevin Durant and Russell Westbrook are already locked into expensive, long-term deals.

    "It's going to be difficult decisions, but we'll see what happens," forward Nick Collison said Saturday. "Obviously, we want everybody back. We feel like we've got a really good core group and we feel like we can get it done with our group, so hopefully it can happen."

    Brooks' situation is the most urgent, with his deal expiring at the end of the month.

    "I'm sure in the next couple of days we will sit down and get together. Definitely, I wish I was preparing or just finishing up practice going into Game 6," Brooks said. "You definitely need a few days just to reflect on what we've done this year. But the next couple of days, we plan on getting together."

    Brooks has overseen a steady improvement since taking over early in the 2008-09 season, when Oklahoma City finished with 23 wins. After that, the Thunder lost in the first round of the playoffs the next year and then were defeated in the Western Conference finals before falling in five games in the NBA Finals this season against Miami.

    "Scotty is my guy for life, no matter what," Durant said during the Finals. "If he's our coach for 10 more years or not, that's my guy. I love him like family. He's pushing me every single day. He demands a lot out of me and when I'm messing up, he's going to tell me. And that's what I need."

    Harden and Ibaka still have a year left under contract but will become eligible for their first contract extension in July. If they don't sign over the next year, they would become restricted free agents ? with the Thunder getting the chance to match any offer from another team.

    "This is something special here. A dynasty is being built here," Harden said. "We're winning, we're having fun and we're brothers. ? The other stuff, you can't buy it. It's the friendships.

    "I'm going to just play the year out and have fun and not worry about it. I'll let them figure that out and discuss all that."

    Harden said his immediate concern is winning a spot on the U.S. Olympic team, along with Durant and Westbrook. Ibaka could also be in the Olympics, representing Spain.

    "I love it here. This team is like a family, like we're really brothers," Harden said. "We hang out most of the time every single day. You can't find any other team like this. I love it here."

    The Thunder have been able to keep their youthful core together, with their best players still under their less-expensive rookie contracts. Durant got his extension two summers ago, and Westbrook signed his new deal in December.

    As more of the team's nucleus gets fatter contracts, the luxury tax becomes a bigger factor.

    "They know they're a big part of what we do here. They know how much we value them as people first and as players. They know how much the city loves them," Durant said. "So, let them do what they do. My job is to be a great teammate and a great friend to them."

    Presti also must decide whether to keep Fisher, who signed with the team after the Los Angeles Lakers traded him in March, and whether to re-sign Mohammed after he agreed to a one-year deal last offseason.

    Backup point guard Eric Maynor, who missed most of the season with a knee injury, is in the same situation as Harden and Ibaka.

    "I can just put that in one word: sacrifice," Maynor said. "If we really want to continue, I feel like we've got something special here. I feel like if guys sacrifice getting something done, then everybody will be here."

    Subaru's EyeSight Offers Old School Accident Avoidance

    Most accident avoidance systems use a combination of optical and radar sensors to recognize cars and pedestrians, but Subaru's new EyeSight system is simpler: using two CCD cameras mounted on either side of the rearview mirror, the arrangement processes stereoscopic images and uses shape recognition software to perceive potential impact, applying brakes when necessary.

    Our nighttime test drive through North Carolina's Outer Banks picked up on cyclists and drunk teenage pedestrians, with the system warning of their presence on the dashboard; though radar-based systems work over longer distances, EyeSight's 80 meter (262 foot) range served our purposes fine. And while some drivers might prefer to switch the accident detection system off if they enjoy aggressively approaching slow moving traffic, our 2013 Subaru Outback tester proved the system's effectiveness when it came to a screeching halt just short of a car mockup.

    Jerry Sandusky guilty of sexual abuse

    BELLEFONTE, Pa. ? Jerry Sandusky was found guilty Friday night on 45 of 48 counts of child sexual molestation and faces up to 442 years in prison.

    A jury of Sandusky's Centre County, Pa., neighbors determined that the former Penn State defensive coordinator sexually abused children over a 15-year period, using his stature as a local coaching hero and his position with the Second Mile charity to target and then violate at-risk kids from the area. The jury deliberated for about 20 hours after a trial that stretched across eight days at Centre County Courthouse. The jury foreman read the counts and said "guilty" on six consecutive counts before saying "not guilty" for the first time. He read all 48 counts.

His wife, Dottie, and three of his adopted sons and one adopted daughter sat to his right. Matt Sandusky, their adopted son who Thursday said Jerry Sandusky had molested him, was not present.

    Sandusky, who was escorted out of the courthouse in handcuffs, will be sentenced at a later date by Judge John Cleland. The precise number of years he faces in prison is unclear, but legal experts say it should be enough to lock the 68-year-old away for life.

    After the counts were read, Judge John Cleland said, "Mr. Sandusky, you have been found guilty by a jury of your peers."

    Victim No. 6 ? one of eight victims to testify ? and his family were in court. He put his head down and wept uncontrollably as the verdict was read. "I'm just overwhelmed," he said afterward.

    When court was adjourned and word leaked out to a massive crowd on the steps of the courthouse, cheers rang out and were audible inside the courtroom.

    "Jerry was prepared to go to jail tonight," defense attorney Joe Amendola said. "He understood that a verdict coming back on the second day [was an indication he would be found guilty]. With the circumstances of the situation and how the case progressed, it was inevitable."

    Judge Cleland said Sandusky would be sentenced in about 90 days. Sandusky gave a quick wave to family and was taken to Centre County jail in handcuffs.

    Amendola said Sandusky plans to appeal. He also said Sandusky would have testified on his own behalf had Matt Sandusky not indicated to prosecutors that he'd been abused.

    "Jerry always planned to take the stand and tell his story," Amendola said. "Although Jerry and the family deny the abuse [of Matt] happened, it would have been explosive. There was no way for Jerry to testify without the prosecution being able to call Matt."

    The case rocked this pristine college area when Sandusky was indicted last November. It led to the firing of iconic head football coach Joe Paterno and school president Graham Spanier. Two other university officials, athletic director Tim Curley and vice president Gary Schultz, are facing criminal charges for failure to report a crime and perjury. Paterno died of lung cancer in January at age 85.

    "The Board of Trustees and current administration maintain a steadfast commitment to pursuing the truth regarding Mr. Sandusky's actions," Penn State said in a statement released following the verdict. "While we cannot change what happened, we can and do accept the responsibility to take action on the societal issue of child sexual abuse ? both in our community and beyond."

    The state presented an overwhelming case against Sandusky. It was highlighted by powerful personal testimony from eight victims who detailed, often through sobs and gasps of breath, how Sandusky molested them in Penn State locker rooms, Sandusky's basement and hotel rooms.

    Sandusky often used his access to Penn State facilities and the football program to lure pre-adolescents into situations where they were alone and the kids were vulnerable.

    The state also used testimony from former Penn State assistant coach Mike McQueary, who said he walked in on Sandusky and a boy in the locker room showers in 2001, and hearsay testimony from two Penn State janitors who said a third janitor ? now senile ? saw a similar incident in 2000.

    The defense acknowledged from the start it faced a considerable challenge and tried to paint Sandusky as an innocent victim of a grand conspiracy of police and financially motivated victims.

    "There are lots of people sitting in jails all across this country who are innocent ? lots of people over the years who have been executed for murder and later determined to be innocent," Amendola said to jeers from the crowd gathered around the courthouse. "What this proves to me is, I believe the jury acted genuinely. I believe the jury acted in good faith. ? I don't have any problem with the jury. We had a good jury."
